By using the website located at https://legacybronze.com and by purchasing any of the services and products of Legacy Bronze Inc., a Delaware corporation (hereinafter, “LB”), you are agreeing to be bound by the following terms of service (“Terms” or “Agreement”).

LB reserves the right to update and change the Terms from time to time without notice.   Continued use of the website after any such changes shall constitute your consent to such changes.  You can review the most current version of the Terms at any time at: https://legacybronze.com/policies/terms-of-service.

1.    Order Placement. You represent and warrant that you are at least eighteen (18) years of age if you are placing an order to purchase products; (ii) LB’s acknowledgement of an order is not acceptance of an order and LB may reject or cancel an order at any time; (iii) you must provide a valid and authorized payment information and agree that LB may charge the selected method of payment at the time of your transaction; (iv) you will pay all charges and losses incurred in connection with your purchase of products, including shipping fees, if applicable; (v) you will pay all applicable taxes; and (vi) if LB does not receive payment from your payment card issuer, you will pay all amounts due upon demand.

2.    Pricing and Shipping. Product pricing includes shipping (to the lower 48 states only) and additional shipping costs (to Alaska or Hawaii) will be as reflected on the website. Prices posted on the website are subject to change at any time without notice to you. LB may offer rush or expedited production services for an additional charge. Prices on the website are in U.S. dollars for U.S. purchasers only; a shipping surcharge will be applied to shipments to Alaska or Hawaii. Expedited shipping may be available and fees will vary depending on distance, time and location. All purchases are subject to applicable taxes to be paid by the purchaser. You acknowledge and agree that shipping delays are out the control of LB. For example, our shipping carrier could temporarily delay delivery of your order due to unavoidable circumstances, such as inclement weather, a natural disaster, a vehicle issue, or labor shortage. If you specify that a product should be shipped directly to a third-party cemetery you hereby represent and warrant that you have advised the cemetery of the direct shipment to ensure that the delivery is not rejected, that the cemetery understands the carrier’s shipping policies, and further you acknowledge and agree that the address that you provided for shipment is accurate and complete. LB carriers offer curbside delivery only; you will be responsible for moving the product to storage and/or its ultimate placement destination.

3.    Delivery Failure and Items Returned by Shipping Company; Address Change. It is your responsibility to ensure that the shipping address is accurate and complete, and that delivery of oversized products may be made. If delivery of a product cannot be made and is returned to LB for any reason, you agree to pay LB a re-delivery fee. LB will not re-ship a product until payment of the re-delivery fee is received. If you need to make a change to the shipping address used on the original order, you will be charged an additional fee as follows:

A.    If your order has not yet been shipped, a $0 fee will apply.
B.    If your order has been shipped and is in mid-transit, a $30 fee will apply.
C.    If your order has been shipped and is almost at its destination, you agree to pay an address change fee based on various factors such as distance, residential or commercial, and delivery type.

4.    Cancellation and Refund Policy; Returns. Because products are customized, once you place an order, you may not cancel your order or return your product except as otherwise set forth herein. While cancellations are rare, our fees for cancellation cover stencil design and processing and are assessed to keep LB’s overall pricing fair and competitive.

A.    If you wish to cancel your order within 1 business day of placing the order, you may do so with a full refund and no cancellation fee, provided, however, that you did not order expedited or rush services.

B.    If you wish to cancel your order within 2 business days after placing the order, you may do so, provided, however, you agree to pay a cancellation fee as follows (and the remaining purchase price will be refunded after the cancellation fee is applied):

C.    For plaques valued under $500.00, a 10% cancellation fee will apply.
2.    For plaques valued between $501.00 and $1,000.00, a 7.5% cancellation fee will apply.
3.    For plaques valued at $1001.00 or greater, a 5% cancellation fee will apply.

Orders may not be cancelled or refunded on or after the 3rd business day after placing the order. After you submit your proof approval, your order is sent to production. Cancellations that occur after proof approval are non-refundable, regardless of the order date. If you request a change or cancellation, we will review your order at the time of the request and communicate any required fees (e.g., design, remake, or rescheduling fees). Changes may affect production timelines.


5.    Damaged Items. Items that are damaged during shipment will be replaced free of charge; provided, however, that you notify us of the damage within 24 hours of delivery. Items that are incorrect due to the fault of LB will be replaced free of charge. Please review your order upon delivery and notify us within 24 hours of mis-engraved items. See Paragraph 9 relating to your responsibility to verify the accuracy of engraved terms.

6.    Layout Changes. We understand that you may wish to make a layout change after you place an order but before your plaques are in production. While some monument companies build in the risk of layout changes to overall pricing, to keep our prices low and fair, we apply layout charges only when required by a particular customer. LB will create up to two additional versions of the proof if you have modifications needed prior to proceeding with production(fee may apply). If additional changes for a proof are required, additional fees will be reviewed and may be applied to the order. 


7.    Product Availability. We cannot guarantee that any product listed on the website will be in stock or remain available. We reserve the right to discontinue offering any product at any time, in our sole discretion. In the event a product is not available at the time you place your order, we will send you a notice via email and cancel your order for the unavailable product. You acknowledge and agree there may be unintentional inaccuracies, omissions, or errors regarding price, offers, descriptions, promotions, availability, or other matters and except as provided by law, LB will not be liable for these inaccuracies, omissions, or errors. LB will attempt to correct such inaccuracies, omissions, or errors when brought to its attention. LB does not claim that the information on the website is appropriate for or applicable to your jurisdiction or that the products described on the website will be available for purchase in all jurisdictions.

8.    No Placement or Installation of 
LB manufactures, engraves, sells, and delivers custom bronze plaques (and related marker products). LB does not provide installation or placement services by default. You are responsible for proper installation and compliance with all cemetery, municipal, and site requirements.
     Optional Installation Add-On: If you would like installation included, it must be purchased as a separate, optional line item and will be clearly listed on your invoice/quote with pricing, scope, and timing. If installation does not appear on your order, it is not included.
     Flat Placement Intended: LB’s marker products are intended for flat placement. Vertical installation is not recommended and may increase the risk of tipping, damage, or injury. If you elect vertical installation against our recommendation, you assume all associated risks and must follow all applicable standards and site rules.
    Pre-attached Plaques to Markers: When a plaque is pre-attached to a stone or base, improper installation of that assembly can cause failure, including cracking, delamination, or fall hazards. Proper anchoring, leveling, substrate preparation, and cure times are the buyer/installer’s responsibility unless LB’s optional installation service is expressly purchased.
    Risk After Delivery/Installation by Others: LB is not responsible for damage to any product after delivery, or for any death, injury, or property damage arising from improper installation, handling, or placement by you or third parties.
    Site Conditions & Permits (if Installation Add-On is Purchased): If you purchase LB’s installation service, you must provide safe access, accurate cemetery approvals, and any required permits/fees. Additional charges may apply for unforeseen site conditions (e.g., rock, frost, underground obstructions).

9.    Materials Appropriate for Intended Use. Some cemeteries do not permit the use of certain materials, therefore you acknowledge and agree that it is your responsibility to ensure that your material choice is permitted in the cemetery where you intend to place the plaque product.

10.    Natural Products. Bronze is a metal alloy with inherent, natural variation. Casting, finishing, and aging can produce differences in color, texture, surface appearance, and patina. These normal variations are not defects, and no refund or replacement will be made for bronze plaques exhibiting standard variations in color, texture, finish, or appearance.
      Color & Patina: Bronze may vary from piece to piece (e.g., warmer or cooler tone, lighter or darker background). Over time, exposure to sun, moisture, salt, and other environmental elements will naturally change the plaque’s appearance (including patina development, darkening, or verdigris). This aging is expected and not a defect.
      Casting Characteristics: Sand-cast bronze may exhibit minor surface character such as subtle texture differences, minute inclusions, or slight relief variation. These are typical of the casting process and not grounds for return or replacement.
      Finishes & Backgrounds: Stipple/leatherette backgrounds, brushed/satin/polished highlights, and edge bevels are hand-applied and may vary slightly in uniformity and tone. Protective coatings (e.g., lacquer/clear coat, if applied) may wear over time and require maintenance based on site conditions.
     Engraving/Lettering & Graphics: Letterforms, stroke weights, and relief depth can vary slightly due to casting and finishing methods. This includes emblems, borders, and raised/etched elements.
     Samples & Proofs: A sample or proof (digital or physical) is a representation only. Final cast color, background tone, and finish can differ from samples for process and environmental reasons. Monitor/screen displays may not accurately show color or sheen.
     Outdoor Exposure: Installed plaques will be subjected to weather and site conditions that affect appearance (sun, wind, precipitation, pollution, coastal salt air, irrigation overspray, etc.). Such changes are normal and not defects. Routine care may be required to preserve appearance.
     Dimensions & Hardware: Dimensions are approximate. Slight variation in overall size, thickness, relief depth, and hole locations can occur due to casting and finishing tolerances.
     Non-Defect Clarification: Normal casting texture, patina changes, minor surface character, finish variation, and color/tonal differences are not defects and do not qualify for refund or replacement.


11.    Engraving and Custom Products. Before placing an order for a customized or engraved bronze plaque, you must carefully review all text, dates, spelling, artwork, and layout for accuracy. Orders are produced exactly as submitted, and you are solely responsible for the content you provide and for final proof approval.
     Content Responsibility: We do not proofread, edit, or pre-screen customer content. Misspellings, incorrect dates, low-quality artwork, or layout issues present in your submission/proof are your responsibility.
     Standard Pricing & Sides: Standard pricing includes engraving/relief on one face of the plaque. If you require engraving on both sides (where technically feasible) or on accessory plates, additional fees apply. Please contact us at [EMAIL] for a quote.
     Artwork & Methods: Bronze plaques may use raised or recessed lettering, emblems, and borders. Provide vector artwork where possible; raster images may incur redraw fees. Certain fine details may be adjusted to meet casting/finishing tolerances.
     Mounting Details: Hole locations, stud patterns, and hardware specifications must be confirmed at proof stage. Changes after proof approval may require remake fees.
     Proof Approval: Your signed/digital proof approval authorizes production. Cancellations or changes after proof approval are non-refundable and may incur additional charges (see Cancellation Policy).
     Right to Refuse: We may reject any submission that does not meet our technical standards or policies. Profane, offensive, libelous, infringing, or otherwise objectionable content will not be produced.
     No Endorsement: Manufacturing a plaque with your submitted text or imagery does not constitute our approval or endorsement of that content.


12.    Porcelain Memorial Photos. LB is an authorized distributor for a third-party supplier of porcelain memorial photos and medallions. If you purchase a porcelain memorial photo or medallion the following additional terms in this Paragraph 10 shall apply to your order. If you intend to install a porcelain memorial photo or medallion on a plaque, you agree to follow the instructions on proper adhesion of the porcelain memorial photo or medallion to the plaque. Our third-party supplier currently offers a lifetime guarantee against breakage, vandalism and deterioration of its products when properly installed. LB may assist you with the submission of a warranty claim with our supplier, but LB offers no guarantee that such warranty claim will be honored, nor does LB expressly or impliedly warrant or guarantee the porcelain memorial photo or medallion against breakage, vandalism and/or deterioration.

13.    Intellectual Property. By placing a custom order, you certify that you possess the lawful right to use all text and content submitted in your custom order and authorize LB to copy, print and use said text and content to customize the product in the quantities requested. You represent and warrant that your submission does not infringe or violate any copyright, trademark, or other intellectual property or proprietary right of a third party or constitute counterfeiting, piracy, misappropriation of another’s idea or rights of privacy or publicity. We reserve the right (but have no obligation) to request confirmation from you in writing of your rights to or permission with respect to any text or content you submit with your order. By visiting the website you acknowledge that the website is owned by LB. Unless otherwise indicated, all of the content featured or displayed on the website, including, but not limited to, text, graphics, product images, product designs, and the selection and arrangement on the website thereof (“LB Content”), is owned by LB or its licensors. All elements of the website, including the LB Content, are protected by copyright, trade dress, moral rights, trademark and other laws relating to the protection of intellectual property and no LB Content may be copied, displayed, or otherwise used by you or provided to a third party without the express written approval of LB.

14.    Production and Shipping. Production and shipping times are estimates only.

We do not ship to P.O. Boxes. All orders must be delivered to a valid physical address where a recipient is available to receive the shipment. For freight or LTL (Less-Than-Truckload) deliveries, the address must have a person onsite during business hours to accept and unload the delivery. Failure to provide an eligible delivery address may result in delays, additional fees, or cancellation of your order.

Customers are solely responsible for coordinating delivery and installation with their chosen cemetery. We do not communicate with cemeteries or make arrangements on behalf of the family. Prior to placing an order, please confirm that your cemetery is able to receive the shipment and that all requirements for delivery and installation are understood. Failure to do so may result in delays, additional fees, or refusal of delivery.

15.    Disclaimer of Warranties. LB SPECIFICALLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

16.    Limitation of Liability. LB IS NOT LIABLE FOR ANY LOSS OF USE, LOSS OF DATA, INTERRUPTION OF BUSINESS, DOWNTIME, LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY, OR OTHERWISE, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IN NO EVENT SHALL LB LIABILITY EXCEED REIMBURSEMENT OF ANY MONIES PAID BY YOU UNDER THIS AGREEMENT AND THIS SHALL BE YOUR EXCLUSIVE AND SOLE REMEDY FOR ANY CLAIM HEREUNDER. THIS SECTION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THIS AGREEMENT

17.    Indemnification. You agree to defend, indemnify and hold harmless LB and its affiliates, members, managers, employees and agents, and waive and release all such parties from all claims, causes of action, suits, allegations, liabilities, expenses, injuries, losses and damages incurred or suffered by LB arising out of or based on any claim or threatened claim based on your use of or access to the website, your violation or breach of any of these Terms, or any violation of any intellectual property rights of any third party.

18.    General Terms.

1.    Force Majeure. LB is not liable for any delay in providing any products or materials hereunder, including but not limited to those arising out of fire, flood, explosion, war, strike, power blackout, nature, general supply chain issues, shipping delays, civil or military authority, pandemic, epidemic, inability to obtain labor or materials or reasonable substitutes therefore, terrorist threats or activities or any other cause beyond LB’s reasonable control or acts of God.

2.    Governing Law and Venue. These Terms will be governed by and construed in accordance with the laws of the State of Arizona, without regard to the principles of conflicts of law, except to the extent those laws are preempted by federal law. The proper venue for any proceeding at law or in equity will be Sacramento County, California, and the parties waive any right to object to the venue.

3.    Attorneys’ Fees. The prevailing party in any dispute regarding this Agreement shall be entitled to receive, in addition to any other remedy or award, reasonable attorneys’ fees and costs incurred in the enforcement of its rights under this Agreement.

4.    Successors and Assigns. You may not assign your rights hereunder to a third party.

5.    Severability. The provisions of this Agreement are independent of and separable from each other, and no provision shall be affected or rendered invalid or unenforceable for any reason any other or others of them may be invalid or unenforceable in whole or in part.

6.    Modifications. LB may modify these Terms at any time by posting a revised version on the website. By accessing the website, you agree to the latest version of these Terms.

7.    Electronic Communications. You consent to receive communications from LB electronically. LB will communicate with you by email or by posting notices on the website. You agree that all agreements, notices, disclosures and other communications that LB provides to you electronically satisfy any legal requirement that such communications be in writing.

8.    Miscellaneous. These Terms constitute the complete and exclusive statement of the agreement between the parties and supersede all proposals, oral or written, and all other communications between the parties relating to the subject matter of these Terms. In the event any information posted on the website from time-to-time conflicts with any provision of these Terms, the applicable provision of these Terms shall control. Any terms and conditions of any other instrument issued by you in connection with these Terms which are in addition to, inconsistent with or different from these Terms shall be of no force or effect. These Terms do not, and shall not be construed to, create any partnership, joint venture, employer-employee, agency or franchisor-franchisee relationship between you and LB. You may not assign, transfer or sublicense all or any of your rights or obligations under these Terms without LB’s express prior written consent. LB may assign, transfer or sublicense all or any of LB’s rights or obligations under these Terms without restriction. The failure of LB to exercise or enforce any condition, term or provision of these Terms will not operate as a waiver of such condition, term or provision. Any waiver by LB of any condition, term or provision of these Terms shall not be construed as a waiver of any other condition, term or provision. If any provision of these Terms is held invalid or unenforceable, the remainder of these Terms shall continue in full force and effect. You agree that a printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

20.    Notice for California Residents. Under California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: LB does not currently charge any fees for access and use of the website.
